Training Course Syllabus:


Participants will become familiar with the relatively new Chapter 16 special ed regulations dealing with Gifted Education, focusing on differences from the IDEA procedure.

This program will also include an overview of evaluation and consent requirements, providing an update on recent guidelines issued by OSEP concerning school district requirements for independent educational evaluations and use of due process to override parental refusal of consent. The presentation will focus on strategies to avoid litigation and due process as well as strategies to ensure success in a due process hearing.

Attorneys' fees and cost recovery in special ed cases is not automatic, and recently became much more tricky; participants will learn how to ensure/vitiate a fee claim, and whether to claim costs.
