Syllabus:
This program will analyze a drunk driving case, with a specific fact scenario, focusing on the analysis of scientific evidence.
The format of the seminar will involve the presentation of a specific case scenario, including videotaped standardized field sobriety tests. Seminar participants will then analyze the case scenario focusing on the scientific evidence, identifying issues and developing strategies for handling these issues.
Participants will advance their skills in analysis of SFSTs and cross-examination of the arresting officer, as well as issues in breath and blood testing.

I. Basic Drunk Driving Defense – A 12-Step Program
This segment will provide an overview of the '12 steps' to successful drunk driving defense.

II. Review And Analysis Of The Fact Scenario – Discovery In An OWI
Case
This segment will discuss the various discovery and open record requests that must be made to effectively analyze the scientific evidence in an OWI case. Specific case scenarios will be analyzed.

III. Standardized Field Sobriety Testing – Science, Superstition,
Common Pitfalls
This segment will address the law, science and superstition of standardized field sobriety testing, including a critique of the National Highway Traffic Administration research. Checklists for correct administrations of SFSTs will be reviewed. The case scenario will be continued with review of the SFST videotapes.

V. Breath Testing – The Intoximeter EC/IR
This segment will explain the science and practice of breath testing in Wisconsin. Several areas of defense will be addressed, again continuing with our case scenario.

VI. Blood Testing, Direct Injection Gas Chromatography
This segment will explain the theory of blood testing in Wisconsin, as well as specific blood testing practices. The practitioner will be alerted to specific areas of defense, again using our case scenario. |
