The HUD Section 3 Proposed Rule clarifies sections of the Interim Rule on jobs, training and contracting opportunities to Section 3 residents and Section 3 businesses located within the covered project or activity. The Final rule is pending publication in the Federal Register. This proposed rule updates the regulations implementing Section 3. The purpose of Section 3 is to ensure that employment, training, contracting and other opportunities to the greatest extent feasible be directed to low and very low income persons and those businesses providing economic opportunities to low and very low income persons. (see full course description)

Many recipients of HUD funding who are required to comply with Section 3 requirements fail to document their efforts to hire low and very low income individuals and contract with companies who hire them. Recipients that fail to comply with Section 3 requirements may result in sanctions, including: debarment, suspension, penalties, or limited participation in HUD programs. Section 3 proposed rule ensures that Public Housing Authorities and other HUD grantees implement consistent procedures determining which residents and businesses to count towards Section 3 compliance.
