PROGRAM DETAILS

A Malpractice Crisis?

Rehabilitation professionals work in a litigious environment, one in which they interact with and care for patients who are injured or sick, and who often present in severe pain. The propensity to claim or sue health care professionals is heightened by patients' constant media exposure to the legal environment and litigation. Sexual harassment and misconduct are two of the fastest growing bases for claims and lawsuits. How do we avoid conflict yet still provide clients with ethical, quality care?

The speaker combines his unique expertise as an Attorney, Physical Therapist, and Educator into a comprehensive course that overviews health care malpractice with a focus on prevention and explores the bases for health care malpractice liability, such as professional negligence (substandard care), intentional misconduct directed towards patients, breach of contractual promises made to patients, patient injuries from dangerously defective or improperly marketed products, and abnormally dangerous clinical activities that could result in patient harm. Participants will self-assess their practices, develop and share preventive risk management strategies, and learn how to utilize alternatives to litigation in the face of patient-provider disputes. In addition, attendees will discuss professional ethical mandates and expectations as well as how ethical and legal standards overlap ("the modern blending of law and ethics"). At the end of this interactive, case-based seminar, participants will feel more at ease and self-confident in professional interactions with patients and relevant others.

• Effectively prevent and manage sexual harassment and misconduct allegations
• Brainstorm and share best practices to limit malpractice liability exposure
• Identify workable alternatives to litigation for interpersonal disputes, including conciliation, mediation, and arbitration
• Develop a systematic model for clinical, ethical problem solving

 

PRESENTER'S BIO

RON SCOTT, PT, JD, EdD, MSBA, MA (Spanish), has been a practicing health care professional since 1970 (Navy LPN and OR tech during the Vietnam War; physical therapist and clinical and risk manager since 1977), and a practicing health law attorney since 1983. In addition to his faculty appointments at RMUOHP, Husson University, NAU, UTHSCSA, University of Indianapolis, University of Montana, University of South Florida, UT Health Science Center San Antonio, and Webster University, Ron is a clinical Physical Therapist based in San Antonio, Texas. His current legal work focuses on health and employment law including liability risk management, and interpersonal dispute mediation. He has authored 13 texts and over 100 articles, is a principal contributor to the APTA's four Law & Liability and Ethics in Physical Therapy monographs, and has chaired its Ethics and Judicial Committee and Risk Management Committee for Occupational Health. He also developed the Law and Liability monograph for the American Academy of Orthotists and Prosthetists.
