Criminal convictions and indictments for HIPAA violations are on the rise. The Department of Justice (DOJ) has issued a memorandum stating that management may be criminally liable for their employees' actions. The Federal Trade Commission (FTC) is investigating patients' complaints. The Office of the Inspector General (OIG) is auditing HIPAA auditors to make sure they are meeting audit mandates. Now, even Your State Attorney General (SAG) has standing to enforce HIPAA through a civil suit.

HHS has fined as much as $4.3 million or entered into a settlement with state agencies, large health plans, hospitals, and physician practices (including small practices), with a majority of their findings citing non-compliance in one or more of the following areas:

  • Failure to perform a risk analysis
  • Failure to update a risk analysis
  • Failure to implement reasonable and appropriate security measures, including adopting policies and procedures
  • Failure to train the workforce
  • Workstation security including encryption

In this climate of heightened HIPAA enforcement, taking action to comply with Omnibus (Mega) Rule changes is an absolute must. Get the knowledge you need to understand HIPAA compliance as soon as possible.
