Description:

Employment background checks are also known as consumer reports. They can include information from a variety of sources, including credit reports and criminal records. When you use consumer reports to make employment decisions, including hiring, retention, promotion or reassignment, you must comply with the Fair Credit Reporting Act (FCRA). Several administrative agencies guide the use of background checks for employers. These agencies include The Federal Trade Commission, which previously enforced the FCRA, but that responsibility was transferred to the Consumer Financial Protection Bureau (CFPB) in 2013. In addition, the Equal Employment Opportunity Commission (EEOC) has issued guidance on use of background checks related to criminal activity, including arrest and conviction records. Financial institutions are further guided by the Federal Deposit Insurance Act, overseen by the FDIC.

The maze of administrative guidance can be further complicated by the logistics of the background check process. Effective January 1, 2013, employers must use updated federal forms as a part of the background check process. At the end of this session, the speaker will handle your specific questions and address any challenges you have had in conducting background and credit checks.
